Two death penalty opinions filing Monday

On Monday morning, the Supreme Court will file its opinions in People v. Johnsen and People v. Bakerthe last undecided cases argued in November.  (Briefs here; oral argument videos here and here.)

All five November cases had a Court of Appeal justice sitting pro tem.

Johnsen is an automatic direct appeal from a June 1994 judgment of death.  The court’s website does not list issues for such cases.  Counsel was appointed in July 1998; new counsel was appointed in October 2006 and original counsel was ordered to reimburse the court over $50,000.  Briefing was completed in March 2018.  Fourth District, Division Three, Justice Raymond Ikola is the pro tem.

Baker is an automatic direct appeal from a January 2009 judgment of death.  Counsel was appointed in March 2012.  Initial briefing was completed in August 2015.  Last May the court asked for supplemental briefing on a Sanchez issue (see here), which also involves the court’s decision last year in People v. Perez.  Third District Justice Harry Hull, Jr., is the pro tem.
