The following is our summary of the Supreme Court’s actions on petitions for review in civil cases from the Court’s conference on Wednesday, January 12, 2011. The summary includes those civil cases, if any, in which (1) review has been granted (not including grant-and-transfers), (2) review has been denied but one or more justices has voted for review, (3) the Court has ordered depublished an opinion of the Court of Appeal, or (4) the Court has denied a Court of Appeal’s publication request.

ALVAREZ v. KMART HOLDING CORPORATION, S188021 —Review Granted and Held—January 12, 2011.

The issue is whether a retailer violates the Song-Beverly Credit Card Act of 1971 (Civ. Code, 1747 et seq.), which prohibits retailers from recording a customer’s “personal identification information” when the customer uses a credit card in a transaction, by recording a customer’s zip code for the purpose of later using it and the customer’s name to obtain the customer’s address through a reverse search database? The same issue is before the court in Pineda v. Williams-Sonoma Stores, Inc., S178241, which was argued earlier this month.
