On Monday morning, the Supreme Court will file its opinion in People v. Wycoff. (Briefs here; oral argument video here.)
Wycoff is an automatic direct appeal from a December 2009 judgment of death. The court’s website does not list issues for death penalty appeals. However, before the oral argument, the court asked the parties to address at the argument, “whether, assuming this court concludes that the trial court erred in finding defendant competent to stand trial without holding proceedings under Penal Code sections 1368 and 1369, a remand is appropriate to allow the trial court to consider the feasibility of holding a retrospective competency hearing.” Counsel was appointed in May 2013. Briefing was completed in February 2017.
The case was argued on the June calendar. Opinions in the three other undecided June cases should file by August 30.
The Wycoff opinion can be viewed Monday starting at 10:00 a.m.
